These files are used by teachers and other school officials and influence decisions made about the student. Parents need to review their child's records to make sure the information is accurate.

IDEA and FERPA Confidentiality Provisions

This resource provides an overview of IDEA/FERPA confidentiality side by side. FERPA gives parents certain rights with respect to their child's education records. These rights transfer to the students when he or she reaches the age of 18 or attends a school beyond the high school level. Student to whom the rights have transferred are "eligible students." However, FERPA allows schools to discuss those records, without consent, to the following parties or under the following conditions.

While FERPA has been revised and amended from time to time during its existence, it has not had a major revision in a number of years. While, legislation is currently being discussed which would update and revise FERPA, action on those amendments is still pending at the time of the preparation of this article. Because it is unknown whether revisions will be enacted any time soon, now is good time to remind ourselves of the basics of FERPA.

Understanding the role

Understanding FERPA: A Legal Overview


This report provides an overview of the Family Educational Rights and Privacy Act (FERPA), as well as a discussion of several court cases that have clarified the statute's requirement. Under FERPA, educational agencies and institutions that receive federal funds must provide parents with access to the educational record of their children. Access must be provided within a reasonable time, but no later than forty-five days after a request.
